Land and Properties Rights Tribunal Engagement OPEN!

Resolution 12-23 : ASBs can support this resolution by participating through the online survey. This is the first review of the LPRT since 2018.

Yesterday the Government of Alberta announced the opening of public engagement aimed at Improving land and property rights services. “Engagement from landowners, developers, industry and municipalities will strengthen the operations of the Land and Property Rights Tribunal (LPRT).” Alberta.ca news announcement

“To further strengthen Albertans’ rights to appeal decisions made regarding their land and property, Alberta’s government has hired an external consultant to review the LPRT business processes to ensure they are effective and responsive to the needs of Albertans.”

MNP has been hired to gather feedback through focus groups, interviews and written submissions. Municipalities, developers, industry groups, assessors, and landowners will be included in the engagement, as well as an online survey available to everyone.

The consultant will evaluate “LPRT’s performance, and effectiveness in meeting its mandate, goals and outcomes. Further review will also consider the LPRT’s accessibility of services and timeliness for carrying out its responsibilities.” To provide feedback through the online survey visit the LPRT Business Process Review and Engagement page.

In 2023 ASBs passed Resolution 12-23: Review of the Land and Property Rights Tribunal. In November of 2023 the ASB Provincial Committee met with the minister and learned that Minister Sigurdson was well aware of the concerns around the Tribunal and had been involved in discussions prior to his appointment as Minister of Agriculture and Irrigation.

Resolution 12-23 asked that “Municipal Affairs establish a task force comprised of Agricultural Service Board Members, agricultural producers, experts in agricultural science, agronomy and business, as well as representatives from the oil and gas industry associations, to conduct a full review into the function and mandate of the Surface Rights components of the LPRT as directed by related legislation, with a focus on matters of, or related to:

  • Contractual negotiations being fully paid by energy operators,
  • Implementation of mandatory mediation prior to LPRT application,
  • Improved timeliness of applications, and
  • Clarity of terms used in the Surface Rights Act.”
